Terms of Service
These terms govern your use of the Material-Sim website and simulation service. By using them, you agree to what follows.

1These terms
These Terms of Service ("Terms") are a contract between you (or the organisation you represent, "you", "Customer") and [Material-Sim Ltd] ("Material-Sim", "we", "us"), company no. [00000000], registered in England & Wales. They govern your access to and use of our website at material-sim.com, the Material-Sim application at app.material-sim.com, the Material Library, and related services (together, the "Service").
If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms. If you do not agree, do not use the Service. A separate written order or agreement, where we have one with you, takes precedence over these Terms to the extent of any conflict.
2The service
Material-Sim provides physics-based process simulation for polymer 3D printing — predicting how a part deforms as it is printed and cools, and generating compensated geometry intended to reduce that deviation. Features, materials and outputs may change as the Service develops.
3Accounts & eligibility
The Service is for business and professional use by people aged 18 or over. You agree to provide accurate registration details, keep your login credentials secure, and not share your account. You are responsible for activity under your account. Tell us promptly at security@material-sim.com if you suspect unauthorised use.
4Early access
The Service is currently offered on an early-access basis. It may contain features that are incomplete, still under evaluation, or subject to change or withdrawal. Access may be limited, and the Service may be interrupted or reset. We provide early access "as is" and, to the extent permitted by law, without the warranties in a general-availability release.
5Acceptable use
You agree not to:
- use the Service unlawfully, or to infringe anyone's rights;
- upload content you do not have the right to use, or that is unlawful or malicious;
- attempt to gain unauthorised access to, disrupt, or test the security of the Service without our written permission;
- reverse engineer, decompile, or attempt to extract the source code, solver models or underlying methods, except to the extent this restriction is prohibited by law;
- scrape, resell, sublicense, or provide the Service to third parties except as expressly permitted;
- use the Service to build a competing product, or to benchmark it for a competitor.
We may suspend access to protect the Service, other users, or ourselves, or where use breaches these Terms.
6Your content
"Customer Content" means the geometry, material selections, process settings, results, and other data you upload or generate using the Service. You keep all ownership of your Customer Content.
You grant us a limited, worldwide, non-exclusive licence to host, copy, process and display Customer Content solely to operate and provide the Service to you, to keep it secure, and to provide support. We will not use your Customer Content to train models for other customers, or disclose it to other customers, without your explicit agreement. You are responsible for having the rights needed to upload your Customer Content and for keeping your own copies. How we handle personal data is set out in our Privacy Policy.
7Our intellectual property
The Service, including its software, solver, physics models, material data, user interface, documentation and branding, is owned by Material-Sim or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription or access period, for your internal business purposes, subject to these Terms. No other rights are granted. If you send us feedback, we may use it without obligation to you.
8Simulation results & validation
Simulation results are engineering predictions, not guarantees. They are computed from models, material data and the inputs you provide, and are subject to modelling assumptions and to the accuracy of those inputs. Real-world results vary with machine, material batch, environment and process.
You are responsible for reviewing results with appropriate engineering judgement and for validating them — including by physical testing — before relying on them. Do not rely on Material-Sim as the sole basis for any safety-critical, structural, medical, regulatory or otherwise high-consequence decision. To the fullest extent permitted by law, we are not liable for decisions made, or parts produced, in reliance on the results.
9Fees & billing
Some access is currently provided free of charge or on a credit basis during early access. Where paid plans apply, fees, usage allowances and payment terms will be set out in an order, quote or plan you accept. Unless stated otherwise, fees are exclusive of VAT and other taxes, which you are responsible for. Except where the law requires or we agree otherwise, fees are non-refundable. We may change pricing on reasonable notice, effective from your next billing period.
10Availability & support
We work to keep the Service available and performing well, but do not guarantee it will be uninterrupted or error-free, and we do not offer a specific uptime commitment during early access. We may carry out maintenance and update or modify the Service. Support is provided by email at hello@material-sim.com on a reasonable-efforts basis.
11Confidentiality
Each party may receive information from the other that is confidential. Each agrees to protect the other's confidential information with reasonable care and to use it only to exercise its rights and meet its obligations under these Terms. This does not apply to information that is public through no fault of the receiving party, already known to it, or independently developed, or where disclosure is required by law.
12Warranties & disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that results will meet your requirements or that any part will print in tolerance. Nothing in these Terms excludes rights you have as a consumer where those cannot be excluded by law.
13Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the fullest extent permitted by law:
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill, anticipated savings, or for wasted materials, machine time, scrapped parts, or data loss;
- our total liability arising out of or in connection with the Service and these Terms is limited, in aggregate, to the greater of the fees you paid us in the 12 months before the event giving rise to the claim, or [£100].
14Term & termination
These Terms apply while you use the Service. You may stop using it and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or, during early access, on reasonable notice. On termination, your right to use the Service ends; we will make your Customer Content available for export for a reasonable period, after which we may delete it. Terms that by their nature should survive (including sections 6, 7, 8, 11–13 and 16) survive termination.
15Changes
We may update these Terms from time to time. We will post the updated version here with a new date, and where changes are material we will take reasonable steps to notify account holders. Continuing to use the Service after changes take effect means you accept them.
16Governing law
These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any non-waivable rights you have in your country of residence.
17General
These Terms, together with any order and our Privacy Policy, are the entire agreement between us on their subject matter. If any provision is found unenforceable, the rest continues to apply. Our not enforcing a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor to our business.
